Affordable Care Act (ACA) subsidies challenged in courts



MADISON, Wis.—July 23, 2014

On July 22, two conflicting federal court decisions were made regarding the legality of federal subsidies for low- and middle-income people who bought health insurance through the Federally Facilitated Marketplace (FFM), or Exchange, in certain states, including Wisconsin.

WPS Health Insurance customers are not affected by these rulings as WPS health plans were not sold on the Marketplace. Therefore, WPS customers do not need to worry about their current policies or coverage.

Court cases

In the first case (Halbig v. Burwell), a panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled, 2-1, that the Affordable Care Act allows subsidies only for insurance purchases made through state-run Exchanges, not the federal Exchange.

In the second case (King v. Burwell), a three-judge panel of the U.S. Court of Appeals for the Fourth Circuit unanimously ruled in favor of the government on the same issue, thus upholding the subsidies.
